Dear NYS Principals and Administrators,

Various city and state agencies have issued apparently conflicting COVID-19 regulations and mandates. Please see below for a clarification of our current understanding of what regulations apply to which programs.

New York State
  • ALL school staff must either be vaccinated or test weekly.
  • All staff and students ages 2 and up must be masked at all times unless engaged in the activities listed in the guidance linked below. See our memo for more info,
  • There is no requirement to test students.

New York City
K-12 Schools:
  • All NYS rules apply.
City-contracted childcare and after school programs (UPK, 3K etc.):
  • According to the DOHMH mandate, all relevant staff must be vaccinated. Schools must keep record of vaccination on file.
  • Medical/religious exemptions are available, but staff will have to work off-site.
  • Programs will have to complete Site Attestation Survey and submit a Vendor Attestation in PASSport. More information and links are provided in the guidance.
DOE Employees:
  • All DOE employees must be vaccinated.
  • Medical/religious exemptions are available, but staff will have to work off-site.
Inspections:

We have received information that city and state agencies have stepped up inspections of childcare programs that receive city or state funding. In addition to the typical inspection items, they are also checking for compliance with city and state COVID requirements.
